Jehovah's Witnesses in Russia, 17 December 2018



"This is complete nonsense and it is necessary to deal with this attentively," Vladimir Putin commented on the inclusion of Jehovah's Witnesses in the list of extremist organizations. A relevant question was posed to him in a session of the Council for the Development of Civil Society and Human Rights, which was held in Moscow on 11 December 2018.



"At such a time, we must be much more liberal. . . . We must treat representatives of all religions in the same way. [We must not] classify them as some kind of destructive ones nor as terrorist organizations."



The rights advocate Ekaterina Shulman called attention to the problem. She pointed out that in the official "List of terrorists and extremists" the majority are 404 organizations of Jehovah's Witnesses. "They certainly do not call for violence and they do not practice it," the rights advocate declared.



In response Vladimir Putin said: "With regard to Jehovah's Witnesses. We certain can, and we even must at such a time be much more liberal toward representatives of various religious sects, but we must not forget that our society does not consist exclusively of religious sects. Ninety percent of citizens of the Russian Federation, or so, consider themselves to be Orthodox Christians. We also have another three actual traditional religions, to which the state provides help. We must treat representatives of all religions in the same way. This is true, but it is still necessary to consider the country and society in which we live. It is true that this does not at all mean that we should classify them as some kind of destructive ones nor as terrorist organizations. Of course, this is complete nonsense and it is necessary to deal with this attentively. Here I agree with you." A bit later the president again returned to the topic of the persecution of Jehovah's Witnesses: "Jehovah's Witnesses are also Christians and for this they are persecuted, and I do not understand this well."



In international forums the government of Russia has already frequently declared that the decisions of Russian courts regarding the liquidation and ban of organizations of Jehovah's Witnesses "do not make an assessment of the teaching of Jehovah's Witnesses and do not contain restriction or prohibition of professing individually the aforesaid teaching." Meanwhile, dozens of citizens of Russia are at the present time in prison or under house arrest merely because of the fact that they profess the religion of Jehovah's Witnesses. Although, knowing the reality of our state, there is no great optimism,” the press secretary of the Jehovah’s Witnesses in Russia, Yaroslav Sivulsky, told BBC.

“It is difficult to call this statement support, but the very fact that he expressed his point of view may be a sign that the accusations against Jehovah’s Witnesses of terrorism and extremism are untenable,” he thinks.

Sivulsky recalled that this is not the first time when Putin was asked about the Jehovah’s Witnesses, although hitherto he has not expressed his own attitude. Thus, in May 2017 German Chancellor Angela Merkel described how at a meeting with Putin she raised a question about the rights of Jehovah’s Witnesses.

Sivulsky also described how Jehovah’s Witnesses wrote many letters to both President Putin and his administration on the eve of the prohibition of the organization by the Supreme Court in April 2017. At the time, he said “even a formal answer” was not received.

“It is difficult to judge what really is happening, but we are nourishing a modest hope that it would be possible to release those who already are in confinement, people who did not commit crimes but simply read the Bible. This is the first thing that law enforcement agencies should do,” Sivulsky suggests.

Dunque Putin ha affermato che

1) È secondo lui assurdo che i TdG vengano considerati un'organizzazione estremista o terrorista

2) Una delle cose che non gli piacciono dei TdG sarebbe che essi non curerebbero i propri figli negli ospedali (cosa che il mondo intero sa essere falsa - np) ma non sarebbe comunque una ragione sufficiente per catalogarli come estremisti/terroristi

3) Parlerà con il presidente della Corte Suprema per affrontare (e risolvere? - np) la questione

Non credo, probabilmente è una questione di pressioni internazionali (da parte di enti umanitari, ma anche di interi governi: vedi ad esempio la presa di posizione della Merkel). Questa persecuzione, che oltre a essere disumana è grottesca nella sua inattualità, è troppo grossolana per passare inosservata.

La Russia ha presentato osservazioni alla Corte europea sulla denuncia del "MRO Glazov e altri c. Russia"


Il 13 dicembre 2018, la Corte europea dei diritti dell'uomo (CEDU) ha riferito ai testimoni di Geova che la Russia ha commentato la denuncia "L'MPO di Glazov e altri contro la Federazione russa". I commenti sul merito recitano: "Le autorità della Federazione Russa sottolineano che la decisione della Corte Suprema della Federazione Russa del 20 aprile 2017 e la definizione di appello della Corte di Appello della Corte Suprema della Federazione Russa del 17 luglio 2017 non valutano la dottrina dei Testimoni di Geova, non contengono restrizioni o divieto di praticare individualmente l'insegnamento di cui sopra " .

"In considerazione di quanto sopra " , continua il vice ministro della Giustizia russo Mikhail Halperin, che ha firmato i commenti, " nel presente caso non vi è alcuna violazione delle disposizioni della Convenzione in relazione alla liquidazione del Centro amministrativo e il divieto delle sue attività".

"Le spiegazioni presentate alla Corte europea sembrano beffarde, specialmente per decine di migliaia di credenti che vivono nel costante timore di una improvvisa ricerca o arresto", ha detto Yaroslav Sivulsky dell'Associazione europea dei testimoni di Geova. " 62 persone sono state lanciate , 7 di loro donne . In questo momento, 26 persone stanno languendo in vari centri di detenzione russe. Affermando che non ci sono violazioni, le autorità aggravano la situazione già disperata con i diritti umani in Russia ".

La denuncia n. 3215/18 ("MRO Glazov e altri c. Russia") è stata depositata per conto di 395 organizzazioni religiose locali (MRO), che sono state liquidate dalla Corte suprema della Federazione russa nell'aprile 2017 insieme al "Centro amministrativo dei testimoni di Geova in Russia". La Corte EDU ha dichiarato accettabile questa denuncia e ha informato che la prenderà in considerazione in via prioritaria.

Separatamente, la Corte europea dei diritti umani ha presentato una denuncia n. 10188/17 ("Centro amministrativo dei testimoni di Geova in Russia e Kalin c. Russia"). Commenti sul merito di questa denuncia La Russia ha inviato alla CEDU nel marzo 2018. Nel dicembre 2018, la Russia ha presentato osservazioni su richieste di risarcimento per entrambi i reclami. Ora i reclami sono presentati alla corte. In attesa di giudizio.

speriamo che tornino libero anche se in effetti mi lascia perplesso la dichiarazione dove dice : e assurdo pensare che sono estremisti come se lui non sapesse nulla? mi sembra strano che lui non sapesse della falsa accusa di estremismo assurda ! un bando chi lo fa ? lo fa un capo di stato e per farlo deve dare un motivo ! e lui non sapeva niente ? non aveva mai sentito la parola assurda estremismo associata ai testimoni di Geova ? sono perplesso ! pero speriamo che riconosca veramente l errore e gli ridia la liberta che avevano prima !

The Federation Council approved the initiative on 21 December.



We recall that previously the Russian Supreme Court explained that it does not consider an extremist publication on the internet to be a crime, if it does not pose a danger for society. Il presidente russo Vladimir Putin ha firmato un disegno di legge che depenalizza parzialmente l'articolo 282 del Codice penale russo (suscitando odio o inimicizia e umiliante dignità umana). Il documento corrispondente è stato pubblicato sul portale internet di informazioni legali.



La nuova versione dell'articolo introduce un chiarimento in base al quale le azioni saranno riconosciute punibili penalmente solo se sono state commesse da una persona dopo essere state ritenute responsabili dal punto di vista amministrativo per un'analoga violazione della legge entro un anno. Il presidente russo ha presentato il progetto di legge alla Duma di stato in ottobre. La Duma di Stato ha adottato la legge in terza lettura il 19 dicembre. Il Consiglio della Federazione ha approvato l'iniziativa il 21 dicembre.



Ricordiamo che in precedenza la Corte Suprema russa ha spiegato che non considera una pubblicazione estremista su Internet un crimine, se non rappresenta un pericolo per la società.
