VLADIMIR PUTIN PARTIALLY DECRIMINALIZES ARTICLE ON EXTREMISM

Russian President Vladimir Putin signed a bill partially decriminalizing article 282 of the Criminal Code of Russia (arousing hatred or enmity along with demeaning human dignity). The corresponding document was published on the internet portal of legal information.
The new version of the article introduces a clarification according to which actions will be recognized to be punishable criminally only if they were committed by a person after being held administratively accountable for a similar violation of law within a year's time. The Russian president introduced the draft law into the State Duma in October. The State Duma adopted the law on third reading on 19 December. The Federation Council approved the initiative on 21 December.
We recall that previously the Russian Supreme Court explained that it does not consider an extremist publication on the internet to be a crime, if it does not pose a danger for society. Judges were required to prove intent, the nature, and the degree of pubic danger in each one of the cases. (tr. by PDS, posted 29 December 2018)

Il presidente russo Vladimir Putin ha firmato un disegno di legge che depenalizza parzialmente l'articolo 282 del Codice penale russo (suscitando odio o inimicizia e umiliante dignità umana). Il documento corrispondente è stato pubblicato sul portale internet di informazioni legali.
La nuova versione dell'articolo introduce un chiarimento in base al quale le azioni saranno riconosciute punibili penalmente solo se sono state commesse da una persona dopo essere state ritenute responsabili dal punto di vista amministrativo per un'analoga violazione della legge entro un anno. Il presidente russo ha presentato il progetto di legge alla Duma di stato in ottobre. La Duma di Stato ha adottato la legge in terza lettura il 19 dicembre. Il Consiglio della Federazione ha approvato l'iniziativa il 21 dicembre.
Ricordiamo che in precedenza la Corte Suprema russa ha spiegato che non considera una pubblicazione estremista su Internet un crimine, se non rappresenta un pericolo per la società. Ai giudici è stato richiesto di dimostrare l'intenzione, la natura e il grado di pericolo pubico in ciascuno dei casi. (tr. da PDS, pubblicato il 29 dicembre 2018)
